$848K verdict in Medical Malpractice case
Penobscot County Superior Court, Bangor, Maine. The Plaintiff underwent surgery at Eastern Maine Medical Center (EMMC) – Northern Light Health for a hernia repair, which was performed by Dr. Rafael Grossman. Within a few days of the surgery, the plaintiff became critically ill and required emergency surgery for a small bowel obstruction. It was determined that Dr. Grossman had placed the mesh backwards and in the wrong location. Considered a “never event” in the medical field because this type of error should never happen, the jury returned a verdict of $848K to compensate for the Plaintiff’s medical expenses, pain and suffering, and permanent injuries caused by the defendant’s negligence.
