Berman & Simmons Attorney Chuck Hehmeyer Presents at the 2021 MTLA Annual Meeting

Berman & Simmons attorney Chuck Hehmeyer recently presented “The Designated Hitter Rule – Deposing a Corporate Designee under Rule 30(b)(6)” at the Maine Trial Lawyers Association (MTLA) Annual Meeting.

During the one-hour CLE Zoom presentation, attorney Hehmeyer discussed the previous challenges litigants faced when corporate officers and agents would express ignorance of facts in depositions, widely known to many within the organization.

Now, under Rule 30(b)(6): if requested, a corporation, partnership, association, or governmental agency must designate persons to testify about matters picked by the questioner that are “known or reasonably available to the organization.” This presentation presented special rules to such depositions and how 30(b)(6) depositions differ from traditional ones. Hehmeyer also provided insights on utilizing this powerful tool.
