Berman & Simmons attorneys, Travis M. Brennan and Charles P. Hehmeyer, have filed a wrongful death and product liability lawsuit on behalf of two families whose Labor Day weekend gathering ended in tragedy when a 2024 Sea-Doo Switch pontoon boat capsized on Flagstaff Lake in Maine, killing three family members and injuring two others.
The lawsuit was filed against Bombardier Recreational Products, Inc., BRP US, Inc., and Richardson’s Boat Yard. According to the complaint, the defendants knew of a capsizing risk associated with the vessel, and a prior safety recall failed to correct the alleged dangerous defect.
Three Family Members Killed in Flagstaff Lake Capsizing
The lawsuit was filed on behalf of three family members who died following the August 30, 2025, capsizing. The suit also represents two surviving family members who were injured.
According to the complaint, six family members and guests boarded the recently purchased Sea-Doo Switch for a ride on Flagstaff Lake. Weather and water conditions were reportedly calm and clear.
At approximately 1:17 p.m., while the boat was traveling at approximately six miles per hour, the front port side allegedly began to nosedive and water entered the deck. Moments later, the vessel capsized in approximately nine feet of water.
Farhana Nasir, Noor Nasir, and Kiran Akbar became trapped beneath the overturned boat. Farhana Nasir and Kiran Akbar were pronounced dead at the scene. Noor Nasir was transported by LifeFlight helicopter to Northern Light Eastern Maine Medical Center, where she remained in critical condition before dying on September 2, 2025.
Khizer Nasir and Hassan Akbar survived the capsizing.
Lawsuit Alleges Defendants Knew of Capsizing Risk
The complaint alleges that Bombardier Recreational Products and the retailer knew of the risk that the Sea-Doo Switch could capsize and that a previous safety recall did not adequately correct the dangerous condition.
