Berman & Simmons' attorneys Travis M. Brennan and Charles P. Hehmeyer have filed a wrongful death lawsuit against Franklin Sports on behalf of the family of 6-year-old Lucy Morgan, who died after a metal badminton racket shaft separated from its handle during normal play and impaled her skull while her family was vacationing in Maine.
The lawsuit alleges the racket was defective and unreasonably dangerous and seeks to hold Franklin Sports accountable for Lucy’s death.
“This case represents a parent’s worst nightmare. The Morgan family was enjoying an idyllic summer vacation here in Maine when they lost Lucy due to what we allege was a dangerous and defective piece of sports equipment. We are committed to obtaining justice for Lucy by holding Franklin Sports accountable. We want to ensure these rackets are manufactured in a way where this type of tragedy never occurs again,” said Berman & Simmons attorney Travis M. Brennan.
