Proving fault in vehicle accident cases

Under Maine Law, recovering damages for injuries caused by a motor vehicle accident requires proving that another person, most often a driver, or a defective product caused your accident.

Berman & Simmons accident lawyers are skilled at proving negligence. To prove fault, we reconstruct the accident scene using a wide variety of investigative tools, including:

  • Police accident investigation
  • Private investigation
  • Photographs of the accident scene and the damage to the vehicles
  • Diagrams and drawings explaining the accident

We also interview witnesses and hire experienced accident reconstruction experts to recreate the events leading up to the crash. To help the jury understand, we use visual representations and models to show—not just tell—how the accident happened.

If you were hurt as a passenger, we'll investigate any claims you may have against the driver of the vehicle in which you were riding, the driver of the other vehicle, or both. We might also advise making a claim against the manufacturer of the car or other vehicle, if your injuries were caused by defective equipment. For more information, see Product Liability.

Proving injury extent in vehicle accident cases

It's not enough to simply establish fault in a motor vehicle accident. To fully recover appropriate damages for you injuries, your lawyer must also provide understandable evidence regarding the extent of your injuries. After proving that another person was at fault in the accident, Berman & Simmons accident lawyers turn their attention and skill to showing how you were injured.

To prove the type and extent of your injuries, our personal injury and accident lawyers work with you and your doctors to present your situation in a personal and compelling way. We help clients who have suffered a wide array of serious harm and we have ready access to top medical experts across the country. These experts help thoroughly evaluate and present your case to the jury.

One of the keys to success is making your injuries understandable to the average juror by presenting them in a compelling and straightforward manner. Our lawyers accomplish this by using anatomical models, drawings, diagrams, X-rays, MRI studies, CT scan studies and other technologies in the courtroom.
