Complex Litigation, Class Action Lawsuits and Environmental and Toxic Torts
Berman & Simmons class action attorneys are experienced at trying complex civil cases, including class actions. We have served as trial counsel in a number of high-profile class-action lawsuits.
Maine class action lawsuits
For example, in 2006, Berman & Simmons attorneys tried a case on behalf of a bottling company competitor of Poland Spring. After a three-week trial, the jury awarded our client $7.8 million.
In 2004, we were lead trial counsel in an antitrust class-action lawsuit on behalf of Maine blueberry growers against blueberry processors. The jury awarded our clients $56 million, every cent of the damages claimed.
We have also served as local counsel in class-action or "mass tort" lawsuits involving:
- Tire chemicals
- Price fixing, collusion and antitrust
- MTBE
- Canadian automobiles
- Hytrin
- Pharmaceuticals
- Paper mill pollution
- Toxic dump sites

How much will our services cost?
You may be wondering how you will pay legal fees while your lawsuit is pending. The good news is—you won't pay anything upfront. We represent all complex litigation, environmental torts, toxic torts or other class action cases on a contingent fee basis. This means we receive fees for our services only if we win. When we've successfully prevailed upon the responsible party or insurer to pay you, that's when we'll receive our payment, as well. Your lawsuit begins with a free case evaluation with a Berman & Simmons lawyer. We will thoroughly explain the details of our fee arrangement during this first consultation.
Why have so many other lawyers and Maine residents come to us over the years? The answer is simple: we get outstanding results.
